Settling an estate as the personal representative of the deceased—either as the Executor under a Will or as Administrator of the estate of one who died without a Will—is a specialized service involving a high degree of trust as well as personal attention to detail. The personal representative is responsible and liable for the collection, preservation and accounting of all estate assets; the payment of all taxes, debts and other obligations of the deceased; and the distribution of the estate assets according to the Will or State law when there is no Will. The personal representative must meet deadlines for filings with the court, Commissioner of Accounts and federal and state taxing authorities and must account for estate assets to the penny.

What is Trust Administration?

The administration of trusts is similar to the administration of estates, except that the person entrusted with the duty of administration is the Trustee. The Trustee must submit annual accountings to the Commissioner of Accounts that account to the penny for the property in his charge and must of course pay the trust’s federal and state income taxes. In addition, the Trustee may distribute or disburse the funds under his control to or for the benefit of the trust beneficiary or beneficiaries for only those things that the Trustmaker permitted in the trust document. Unlike administration of a decedent’s estate, which may be complete in a year or so, a Trustee may need to administer the trust for many, many years. As a result, Trustees also may need to conserve the trust property while still using it for the beneficiary’s needs.
